1 About EVolte
EVolte Ecosystem Pvt. Ltd. ("EVolte", "we", "us", or "our") is a company incorporated under the Companies Act, 2013, with its principal place of business in Bhubaneswar, Odisha, India. EVolte operates as India's Electric Auto Fleet Leasing and Management Platform, providing L5 electric three-wheeler leasing, fleet management services, and driver empowerment programs under the Swabhiman Scheme.
Our website evolte.in provides information about our services, driver enrollment, and contact channels for prospective drivers, passengers, investors, and partners.
2 Acceptance of Terms
By accessing or using our website or services, you confirm that:
- You are at least 18 years of age and legally capable of entering into a binding agreement under the Indian Contract Act, 1872
- You have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy
- If you are enrolling as a driver, you hold a valid commercial driving licence (badge) as required under the Motor Vehicles Act, 1988
- All information you provide to EVolte is true, accurate, current, and complete to the best of your knowledge
3 Use of Website
You agree to use the EVolte website only for lawful purposes and in accordance with these Terms. You must not:
- Use the website in any way that violates applicable local, national, or international law or regulation
- Submit false, misleading, or fraudulent information through any form, enrollment process, or communication channel on our website
- Attempt to gain unauthorized access to any part of our website, server, or connected systems
- Transmit any unsolicited or unauthorized advertising or promotional material (spam)
- Reproduce, duplicate, copy, or re-sell any part of our website in contravention of these Terms
- Use automated tools, bots, or scrapers to access or extract data from our website without prior written permission
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
EVolte reserves the right to restrict or terminate your access to the website at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to us, our users, or third parties.
4 Driver Enrollment & Swabhiman Scheme
The Swabhiman Scheme is EVolte's flagship Lease-to-Own program for electric auto-rickshaw drivers (Uttam Chaalaks). Enrollment is subject to the following conditions:
- You must hold a valid commercial driving licence (badge) issued by the appropriate Regional Transport Office (RTO)
- You must be a resident of Bhubaneswar or the area of EVolte's current operational zone
- You must submit valid government-issued identity documents including Aadhaar Card, Voter ID, and Driving Licence for KYC verification
- You must consent to a background verification check, including verification of your driving record and any prior criminal history
- You must be willing to operate the vehicle strictly within the permitted zone and in compliance with all applicable traffic and motor vehicle laws
Enrollment via Google Forms: Submission of an enrollment form through our website does not guarantee acceptance into the Swabhiman Scheme. Enrollment is subject to successful KYC verification, background check clearance, vehicle availability, and EVolte's sole discretion in selection.
The specific terms of the lease — including daily rental amount, lease tenure, maintenance responsibilities, and conditions for vehicle ownership — shall be governed by a separate Lease Agreement executed in writing between EVolte and the enrolled driver. In case of any conflict between these Terms and the individual Lease Agreement, the Lease Agreement shall prevail.
5 Lease Agreement Terms
The following general principles apply to all lease arrangements under the Swabhiman Scheme. Specific terms are detailed in the individual written Lease Agreement:
- Daily Rental: The driver agrees to pay a fixed daily rental as specified in the Lease Agreement. Failure to pay on time may result in suspension or termination of the lease.
- Vehicle Use: The leased vehicle must be used solely for the purpose of ferrying passengers commercially and must not be used for any illegal, unauthorized, or non-commercial purpose.
- Maintenance: EVolte is responsible for routine scheduled maintenance and battery health management. The driver is responsible for reporting any defects, accidents, or damage immediately and must not attempt unauthorized repairs.
- Insurance: EVolte shall maintain valid vehicle insurance as part of the lease arrangement. The driver must comply with all insurance-related requirements and must not operate the vehicle when it is uninsured or when the insurance is suspended.
- Damage & Loss: The driver shall be liable for damage caused due to negligence, reckless driving, or willful misconduct. EVolte shall determine the extent of liability in such cases.
- Return of Vehicle: Upon termination of the lease for any reason, the driver must return the vehicle to EVolte in good working condition, reasonable wear and tear excepted, within the timeframe specified in the Lease Agreement.
- Ownership Pathway: The pathway to ownership described under the Swabhiman Scheme is subject to the driver meeting all performance, payment, and compliance conditions as specified in the Lease Agreement.
6 Fleet Management & Telematics
All EVolte vehicles are equipped with a Fleet Management System (FMS) incorporating GPS, telematics sensors, and IoT connectivity. By accepting a vehicle under the Swabhiman Scheme, the driver acknowledges and consents to:
- Real-time tracking of the vehicle's location throughout all operating hours
- Collection and monitoring of speed, braking patterns, acceleration, idling time, and other driving behavior metrics
- Remote monitoring of battery health, state of charge, and vehicle diagnostics
- Recording of trip history, including origin, destination, route, and duration
- Use of AI-driven demand prediction tools to optimize earnings and route recommendations
Telematics data is used solely for operational management, safety oversight, predictive maintenance, and driver performance support. EVolte will not use this data to unfairly discriminate against drivers. Drivers may request access to their own trip data by contacting Drive@evolte.in.
7 Intellectual Property
All content on the EVolte website — including but not limited to the EVolte name and logo, website design, text, graphics, photographs, videos, icons, data, software, and the selection and arrangement thereof — is the exclusive property of EVolte Ecosystem Pvt. Ltd. and is protected by applicable Indian and international intellectual property laws.
- You may not reproduce, republish, distribute, modify, create derivative works of, or commercially exploit any content from our website without our prior written permission
- You may not use the EVolte name, logo, or brand in any manner that implies endorsement, partnership, or affiliation without written authorization from EVolte
- Limited permission is granted for personal, non-commercial use to view and print pages from our website solely for your own reference
Any unauthorized use of EVolte's intellectual property may result in civil and/or criminal liability under the Copyright Act, 1957 and the Trade Marks Act, 1999.
8 Disclaimers & Limitation of Liability
Website Disclaimer: The information on our website is provided for general informational purposes only. Limitation of Liability: To the fullest extent permitted by applicable law, EVolte shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

- Any road accident, vehicle damage, or loss occurring during operation of a leased vehicle, except as expressly covered under the insurance policy maintained by EVolte
- Loss of earnings, data, goodwill, or business opportunity arising from service disruptions
- Reliance on any information provided on our website
9 Termination
EVolte reserves the right to terminate or suspend your access to our website and services — including enrollment in the Swabhiman Scheme — with or without notice, for the following reasons:
- Breach of these Terms and Conditions or the individual Lease Agreement
- Submission of false, fraudulent, or misleading information during enrollment or during the lease period
- Failure to make rental payments as agreed
- Conduct that EVolte determines to be harmful to other drivers, passengers, or the EVolte brand
- Revocation of commercial driving licence by any government authority
- Non-compliance with applicable traffic laws, motor vehicle regulations, or EVolte operational guidelines
Upon termination, all rights granted to you under these Terms immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — shall continue to apply.
10 Governing Law & Dispute Resolution
These Terms and Conditions and any disputes arising from or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Dispute Resolution: In the event of any dispute, claim, or controversy arising out of or in connection with these Terms or our services, the parties shall first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, the matter shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
- The seat of arbitration shall be Bhubaneswar, Odisha, India
- The language of arbitration shall be English
- The arbitration award shall be final and binding on both parties
Subject to the above, the courts of Bhubaneswar, Odisha shall have exclusive jurisdiction over any disputes that are not resolved through arbitration.
11 Amendments
EVolte reserves the right to revise, update, or replace these Terms and Conditions at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you via email or a prominent notice on our website.
Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review this page periodically to stay informed of any updates.
