1 Acceptance of Terms

By accessing or using EVolte's website, submitting any enrollment or contact form, communicating with us via WhatsApp, or engaging with our services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms apply to all visitors, users, prospective drivers, enrolled drivers, passengers, business partners, and any other persons who access or use our services.

2 About EVolte

EVolte Ecosystem Pvt. Ltd. is an electric vehicle fleet leasing and management company registered in India. We operate India's first Electric Auto Fleet Leasing and Management Platform, currently launching in Bhubaneswar, Odisha, in alignment with the Odisha State EV Policy 2021.

Our core services include:

• Leasing of L5 category electric three-wheelers to drivers under the Swabhiman Scheme
• Fleet management, maintenance, and battery health monitoring
• Driver onboarding, training, and support
• Technology-enabled mobility solutions for passengers and businesses

3 Use of Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the website in any way that violates applicable local, national, or international laws or regulations
• Transmit any unsolicited or unauthorised advertising or promotional material
• Attempt to gain unauthorised access to any part of our website or its related systems
• Knowingly introduce viruses, malware, or any other harmful material to our website
• Reproduce, duplicate, copy, or resell any part of our website in violation of our intellectual property rights
• Submit false, misleading, or fraudulent information through any form on our website

We reserve the right to suspend or terminate access to our website for any user who violates these terms, without prior notice.

4 Driver Enrollment & Swabhiman Scheme

The Swabhiman Scheme is EVolte's flagship Lease-to-Own programme designed to empower auto-rickshaw drivers with access to electric vehicles on affordable daily rental terms.

By submitting the Driver Enrollment Form, you confirm that:

• You are at least 18 years of age and a resident of India
• You hold a valid driving licence appropriate for L5 category three-wheelers
• All personal, identity, and document information submitted is true, accurate, and complete
• You consent to EVolte conducting a background and bureau check using your submitted OTP consent
• You understand that submission of the enrollment form does not guarantee approval or onboarding
• EVolte reserves the right to accept or reject any application at its sole discretion

5 Leasing Terms and Obligations

Upon successful enrollment and approval, a separate Lease Agreement will be executed between EVolte and the driver. The following general terms apply to all lease arrangements:

• Daily rental amounts, payment schedules, and lease duration will be specified in the individual Lease Agreement
• The leased vehicle remains the property of EVolte until full ownership transfer conditions are met under the Lease-to-Own terms
• Drivers are responsible for the safe and lawful operation of the vehicle at all times
• EVolte is responsible for scheduled maintenance, battery health monitoring, and major repairs
• Drivers must not modify, sublet, or transfer the leased vehicle without prior written consent from EVolte
• Any damage caused by driver negligence or misuse may be recovered from the driver as per the Lease Agreement
• Failure to make timely rental payments may result in suspension or termination of the lease

All specific financial terms, penalty clauses, and ownership transfer conditions will be detailed in the signed Lease Agreement provided at the time of onboarding.

6 Passenger and Customer Terms

Passengers using EVolte-operated rides or booking services agree to the following:

• Rides are provided subject to vehicle availability and driver acceptance
• Passengers must behave respectfully toward drivers and other passengers at all times
• EVolte is not liable for delays, cancellations, or service interruptions caused by external factors including traffic, weather, or vehicle breakdowns
• Any disputes regarding fares or service quality should be reported to EVolte via our official contact channels
• Passengers are responsible for their personal belongings during rides

7 Intellectual Property

All content on the EVolte website — including but not limited to text, graphics, logos, images, icons, designs, and software — is the property of EVolte Ecosystem Pvt. Ltd. and is protected by applicable Indian and international intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works of any content without our prior written permission
• The EVolte name, logo, and brand identity are registered trademarks and may not be used without authorisation
• Unauthorised use of our intellectual property may result in legal action

8 Disclaimers and Limitation of Liability

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

• EVolte does not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components
• We do not guarantee specific earnings or income outcomes for enrolled drivers — actual earnings depend on individual effort, market conditions, and other factors
• EVolte shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
• Our total liability to any user shall not exceed the amount paid by that user to EVolte in the preceding 3 months

9 Indemnification

You agree to indemnify, defend, and hold harmless EVolte Ecosystem Pvt. Ltd., its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with:

• Your use of or access to our website or services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any false or misleading information submitted by you
• Any third-party claim arising from your use of our services

10 Termination

EVolte reserves the right to suspend or terminate your access to our website and services at any time, with or without cause, and with or without notice, including if we reasonably believe you have violated these Terms.

Upon termination:

• Your right to use our website and services immediately ceases
• Any outstanding obligations under a Lease Agreement remain enforceable
• Provisions of these Terms that by their nature should survive termination will continue to apply

11 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bhubaneswar, Odisha, India.

Before initiating any legal proceedings, the parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

12 Changes to Terms

EVolte reserves the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates. Material changes will be communicated through our website or via direct communication where applicable.
